A side-impact collision is the crash type where liability is most often genuinely disputed. In a rear-end crash, the physical arrangement tells you most of what you need to know. At an intersection, both drivers arrive believing they had the light, and the insurers on each side start from opposite assumptions.

That makes T-bone cases evidence cases. What decides them is not whose story is more convincing — it is what the signal timing, the vehicle damage geometry, and the independent witnesses show.

Why Side-Impact Crashes Are So Severe

A car’s front and rear are engineered as crumple zones — substantial structure designed to absorb energy before it reaches the occupants. The side is not. Between the striking vehicle and the person sitting in the seat there is a door, a few inches of trim, and whatever side-impact protection the model includes.

The occupant on the struck side takes the force almost directly. Common results include traumatic brain injury, spinal damage, rib and pelvic fractures, and internal organ injury from the intrusion of the door into the occupant space.

Height mismatch makes it worse. When a pickup or SUV strikes a sedan at the door, the striking vehicle’s bumper is at roughly chest height for the person in the seat.

Proving Who Had the Right of Way

This is the whole case. California Vehicle Code §21800 through §21804 govern right-of-way at intersections — who yields at a controlled intersection, at an uncontrolled one, when turning left, and when entering from a driveway or private road. Section §21453 governs red lights, and §21801 governs left turns across oncoming traffic.

Establishing which applied, and who violated it, comes down to evidence that decays quickly.

Signal Timing Data

Fresno’s signalized intersections run on controllers that log phase timing. Where the dispute is whether a light was red or yellow, that data can settle it — but it is held by the City of Fresno’s traffic department or Caltrans depending on the intersection, retention periods are limited, and obtaining it generally requires a formal records request or a subpoena. This is not something to get around to in a few months.

Surveillance Footage

The major Fresno intersections are commercial. Shaw and Blackstone, Shaw and Cedar, Herndon and Blackstone — every corner has businesses, and many have exterior cameras that capture the roadway. Most overwrite within seven to thirty days. Canvassing has to happen in the first week.

Damage Geometry

Where each vehicle was struck, and at what angle, tells an accident reconstructionist a great deal about approach speeds and the position of each car at impact. This is why photographs of both vehicles from multiple angles matter, and why you want the vehicles documented before they are repaired or scrapped.

Independent Witnesses

In a disputed-light case, an uninvolved witness at the intersection is often the single most valuable piece of evidence. They leave the scene quickly. Get names and numbers before they do.

Event Data Recorders

Most vehicles built in the last two decades record speed, braking, throttle position, and seatbelt status in the seconds before impact. Retrieving that data requires access to the vehicle, which is a reason not to let an insurer total and dispose of a car before it has been inspected.

Left-Turn Collisions

A substantial share of T-bone crashes involve a left turn. Under Vehicle Code §21801, a driver turning left must yield to oncoming traffic that is close enough to constitute a hazard.

The turning driver is frequently found at fault, but not always. If the oncoming driver ran a red light, or was traveling substantially over the speed limit such that they were not “close enough to constitute a hazard” when the turn began, fault shifts or splits. Under California’s pure comparative fault rule, both drivers can bear a percentage.

When the Intersection Itself Is the Problem

Sometimes the design is a contributing cause — obstructed sight lines, a malfunctioning or badly timed signal, missing or obscured signage, faded lane markings.

Where a public entity’s dangerous condition of public property contributed, a claim against the City of Fresno, Fresno County, or Caltrans may be available under Government Code §835. These claims carry a six-month administrative deadline under Government Code §911.2, not two years. That is the shortest deadline in California injury practice and it is the one people miss most often.

Fresno’s High-Risk Intersections

Shaw Avenue is the corridor most associated with intersection collisions here. High volumes, high speed limits, and signalized crossings at close intervals — Shaw and Blackstone, Shaw and Cedar, Shaw and Fresno Street, Shaw and First all carry heavy cross-traffic.

Blackstone Avenue combines through traffic with constant turning movements into commercial driveways, producing side-impact crashes that are not at signalized intersections at all.

Herndon Avenue in north Fresno handles volumes its design did not anticipate, with major crossings at Blackstone, Fresno Street, and Cedar.

Kings Canyon Road and east Fresno see collisions driven by signal timing and limited sight lines.

Rural county intersections present a different hazard: two-lane roads meeting at stop signs with agricultural equipment, obstructed sight lines from crops, and vehicles traveling at highway speeds.

What to Do After a T-Bone Crash

Call 911. The officer’s determination of right-of-way carries weight, and their observations at the scene are documented while everything is fresh.

Get witness information immediately. This matters more here than in almost any other crash type. Anyone who saw the light is worth finding.

Photograph both vehicles and the intersection. Damage from several angles, the signal heads, sight line obstructions, skid marks, and debris field. Photograph the storefronts on each corner so you know which businesses to ask about cameras.

Do not concede anything about the light. “I think it was yellow” said at the scene becomes an admission months later.

Get medical evaluation. Side-impact injuries include internal damage that is not immediately apparent.

Do not let the vehicle be disposed of before it has been inspected and its event data recorder downloaded.

Frequently Asked Questions

Both of us say we had the green light. How does that get resolved?

Through evidence rather than testimony. Traffic signal timing data, surveillance footage from nearby businesses, independent witnesses, vehicle damage geometry, and event data recorder downloads. Most of that evidence has a short shelf life, which is why the investigation cannot wait.

Is the driver turning left always at fault?

No. Vehicle Code §21801 requires a left-turning driver to yield to oncoming traffic close enough to be a hazard, and they are often found at fault. But if the oncoming driver ran a red light or was speeding substantially, fault shifts or splits between them under California’s pure comparative fault rule.

The police report says I was at fault. Is that the end of it?

No. A police report is an officer’s opinion based on what they could determine at the scene. It is not binding, and it is frequently revised when signal data, footage, or reconstruction shows something different. Officers rarely have access to that evidence when they write the report.

Can I sue the city if the intersection was badly designed?

Possibly, under Government Code §835 for a dangerous condition of public property. But claims against public entities require an administrative claim within six months under Government Code §911.2 — not two years. Missing that deadline ends the claim.

My car was totaled and the insurer wants to dispose of it. Is that a problem?

It can be. The vehicle holds evidence — damage geometry and the event data recorder. Once it is gone, so is that evidence. Tell your attorney before authorizing disposal.

How long do I have to file?

Two years from the crash under Code of Civil Procedure §335.1 for a claim against another driver. Six months for an administrative claim if a government entity is involved.
