Head-on collisions produce the most severe outcomes of any crash type, for a reason that is simple physics: the closing speed is the sum of both vehicles. Two cars traveling 55 miles per hour meet at a combined 110. No vehicle safety system is designed for that.
The practical consequence for a claim is that damages in these cases routinely exceed the at-fault driver’s insurance. Recovery usually depends on finding coverage beyond the obvious policy — and that search has to start early, while the evidence establishing who else is responsible still exists.
How Head-On Crashes Happen
These are almost always the result of a vehicle leaving its lane:
Impairment. Alcohol and drugs degrade lane-keeping before they degrade anything else. Where impairment is involved, punitive damages may be available beyond compensatory recovery.
Fatigue. A drowsy driver crossing the center line is a leading cause on rural roads and on long freight routes. Where the driver was a commercial operator, federal hours-of-service rules and driver logs become central evidence.
Unsafe passing. On two-lane roads, a driver pulling out to pass without adequate sight distance meets oncoming traffic directly. Vehicle Code §21752 restricts passing where the view is obstructed.
Wrong-way driving. Usually a driver entering a freeway via an off-ramp, disproportionately at night and disproportionately impaired. Where signage or ramp design contributed, Caltrans may share responsibility.
Medical emergency. A driver who loses consciousness may raise the sudden emergency doctrine as a defense — but it does not apply where the driver knew or should have known they were at risk of the event.
Road conditions. Missing center dividers, inadequate lighting, poor sight lines, or construction zones that route traffic into oncoming lanes.
When Damages Exceed the Policy
California’s minimum liability coverage is $30,000 per person and $60,000 per accident. A catastrophic injury generates medical costs that exhaust that in the first week of hospitalization.
Finding additional coverage is usually the work that determines what a family actually recovers:
Your own UM/UIM coverage. Underinsured motorist coverage applies where the at-fault driver has insurance but not enough. This is the most commonly overlooked source, and many people carry it without knowing.
Employer liability. If the at-fault driver was working — on a delivery, in a company vehicle, traveling between job sites — the employer’s commercial policy may apply, typically with limits an order of magnitude higher than personal auto coverage. Whether the driver was in the course and scope of employment is a fact question worth investigating in every case.

Vehicle defect claims. Where a mechanical failure caused the lane departure — steering, tire, or brake failure — the manufacturer may bear responsibility.
Public entity liability. Where road design or maintenance contributed, a claim against Caltrans, Fresno County, or the City of Fresno may be available under Government Code §835. These require an administrative claim within six months under Government Code §911.2.
Umbrella policies. Some drivers carry personal excess liability coverage above their auto policy. It is not always disclosed voluntarily.
When Someone Does Not Survive
Where a head-on crash is fatal, two claims may exist under California law, and they compensate different losses.
A wrongful death claim under Code of Civil Procedure §377.60 belongs to surviving family members — typically the spouse, domestic partner, and children — and compensates their loss: financial support, household services, and the loss of the person’s love, companionship, and guidance.
A survival action under §377.30 belongs to the estate and covers what the person themselves lost between injury and death, including medical expenses and lost earnings.

Where These Crashes Happen in Fresno County
Rural county roads are where head-on collisions concentrate here. Two lanes, no center divider, no shoulder, limited lighting, and traffic at highway speeds. Agricultural equipment moving slowly on the same roads creates passing situations that go wrong.
Highway 99 produces crossover crashes and wrong-way incidents, with freight traffic making the outcomes worse.

If You Are Able
Much of the usual advice does not apply here — in a serious head-on crash, no one is photographing the scene. Family members often handle what follows.
Preserve the vehicles. Do not authorize disposal. Both vehicles hold evidence: damage geometry, event data recorder downloads, and any mechanical failure that contributed.
Get the CHP or police report, including the traffic collision report number.
Keep every medical record and bill. These build the damages case and the eventual life care plan.
Do not give any insurer a recorded statement, including your own, before speaking with an attorney.
Do not accept an early offer. In catastrophic cases, early offers are made before the long-term prognosis is known, which is precisely why they are low.

This is common in head-on cases. Identifying every available source is usually the most important work in these cases.
The at-fault driver died in the crash. Can we still recover?
