CONFLICT OF INTEREST WAIVER


Rule 3-310 (C), Rules of professional Conduct provides that an attorney may not simultaneously represent more than one client’s interests if such interests potentially or actually conflict, without the informed written consent of all of the clients sought to be represented.

Multiple representation may result in economic or tactical advantages; however, multiple representation also involves significant risks. First, multiple representation may result in divided, or at least, shared attorney-client loyalties. Although WAGNER LAW GROUP P.C. is not currently aware of any actual or reasonably foreseeable adverse effects of such divided or shared loyalty, it is possible that issues may arise as to which WAGNER LAW GROUP P.C.’s representation of one client’s individual interests may be materially limited by WAGNER LAW GROUP P.C. representation of the others.

Because WAGNER LAW GROUP P.C. has been jointly retained by more than one client in this matter, in the event of a dispute between you as a client, the attorney-client privilege generally will not protect communications that have been taken place among both of you and WAGNER LAW GROUP P.C.. Pursuant to this ‘joint client’ arrangement, anything you disclose to WAGNER LAW GROUP P.C. which is material to this matter may be disclosed to the others as there can be no ‘confidentiality’ between joint clients.

If a conflict or dispute were to arise, WAGNER LAW GROUP P.C. would continue to represent the others and withdraw from representing you. The case file would remain a privileged and confidential record of the clients who remain represented by WAGNER LAW GROUP P.C. and therefore, be inaccessible to you as the former client. By your signature below, you hereby agree to that process.

By signing this document and consent, you acknowledge you waive any potential conflicts as set forth in this agreement regarding the representation of more than one client jointly in this matter.
